At BRAINSTOY LLC, we want every customer to be completely satisfied with our products.
This policy explains how shipping works depending on who fulfills your order.
All purchases completed through our Square Online Store are shipped directly by BRAINSTOY LLC from Massachusetts, USA. We do not currently use third-party fulfillment centers.

1. Geographic Coverage

We currently ship to the 48 contiguous United States only.

We do not ship to Alaska, Hawaii, U.S. territories (including Puerto Rico, Guam, or the U.S. Virgin Islands), to Armed Forces addresses (APO/FPO/DPO), or to Freely Associated States such as Micronesia, the Marshall Islands, or Palau.

Orders placed from outside our service area (including non-contiguous U.S. regions or foreign addresses not served by U.S. carriers) will be automatically canceled and refunded.

All orders are shipped from Massachusetts, USA.

2. Orders Processed Through Square and Fulfilled by Brainstoy

All purchases are completed through our official Square Online Store, which opens when you click a product from our catalogue on brainstoy.com.

All purchases made through our Square Online Store are processed securely by Square or its approved payment partners.

Square encrypts and transmits payment information in accordance with industry standards and its own security and PCI compliance requirements.

While Square manages the payment process and customer account options, BRAINSTOY LLC handles all order fulfillment, packaging, and shipping within the United States.

 

2.1 Shipping

Orders are usually prepared and shipped within 1–2 business days after payment is confirmed.
Orders placed after 2:00 p.m. Eastern Time or on weekends/holidays will begin processing the next business day.

Processing time is separate from carrier transit time. Processing refers to the time required to prepare your order before shipment; it does not include weekends or postal holidays.

We ship orders via USPS, UPS, or FedEx depending on destination. Orders are shipped only within the contiguous United States. Deliveries outside this area cannot be processed.

Most U.S. customers receive their orders within 3–7 business days.

Once your order ships, you will receive an email confirmation containing your tracking number and carrier link so you can follow your shipment’s progress.

Please note that BRAINSTOY LLC cannot guarantee delivery times once an order has been handed over to the shipping carrier. Delays due to carrier volume, weather conditions, or customs procedures are beyond our control.

Tracking emails may be sent via Sender.net and may be triggered through automated integrations using Make.

2.2 Shipping Costs

Shipping fees are calculated at checkout based on your delivery location, package weight, and shipping method. These costs will be clearly shown before you complete your purchase on our Square Online Store. We do not currently offer free shipping unless otherwise specified in a promotion or on the product page. Shipping promotions or discounts, if any, will be clearly stated on the product or checkout page.

Shipping fees are non-refundable once an order has been shipped, unless otherwise required by law.

2.3 Sales Tax

Sales tax may be applied at checkout depending on your shipping address and applicable state and local tax laws. Taxes are calculated and collected through Square’s automated tax system. For example, Massachusetts residents will see applicable state sales tax added at checkout.

2.4 Lost or Missing Packages

If your package is marked “Delivered” but you haven’t received it:

  • Check with neighbors or household members to see if they accepted the package.
  • Contact the carrier (UPS, USPS, or FedEx) directly for delivery confirmation or support.
  • If you are unable to locate your package, please contact us through our Contact Form within 7 days of the marked delivery date. Claims submitted after this period may not be eligible for investigation or replacement.

Once a package leaves our facility, delivery is managed by the shipping carrier. While BRAINSTOY LLC does not guarantee compensation for packages marked as “Delivered” by the carrier, we will make reasonable efforts to assist you, including helping to initiate a carrier investigation or claim if appropriate.

In select cases, at our discretion, we may offer a replacement or partial refund depending on the circumstances and shipping insurance availability.

We may request proof of non-receipt, such as a carrier claim reference number, before issuing refunds. We may also ask for a signed affidavit confirming that the package was not received.

If a replacement or refund is issued, it will be limited to the product cost and applicable taxes; original shipping fees are non-refundable.

2.5 Holiday & High-Volume Shipping Delays

During peak periods such as holidays, promotional events, or weather emergencies, fulfillment and delivery times may be extended. We appreciate your patience during these times and encourage early ordering to ensure timely arrival. During these periods, shipping carriers may suspend guaranteed delivery services. BRAINSTOY LLC cannot issue refunds for carrier-delayed deliveries during such events.

2.6 P.O. Boxes, Military, and Out-of-Area Addresses

We can generally deliver to P.O. Boxes within the contiguous United States through the United States Postal Service (USPS).

However, certain orders may require a physical street address due to carrier restrictions, package size, or service limitations. In such cases, we may contact you to request an alternate address or reserve the right to decline shipment to a P.O. Box at our discretion.

We do not ship to Alaska, Hawaii, U.S. territories (including Puerto Rico, Guam, and the U.S. Virgin Islands), to APO/FPO/DPO military addresses, or to Micronesia, the Marshall Islands, or Palau, as these destinations are outside our carrier service area.

3. Governing Law

This Policy is governed by and interpreted in accordance with the laws of the United States and the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

Any disputes arising from or related to this Policy or your use of our website shall be subject to the exclusive jurisdiction of the courts located in Massachusetts, USA.

We may update this Policy from time to time to reflect changes in our practices, our business operations, or applicable laws and regulations.

Any updates will be posted on this page with a new “Effective Date.”

If the changes are significant, we may also provide an additional notice (for example, a website banner or email notification) so you can review the updates before they take effect.

Your continued use of the website after any changes have been posted will signify your acceptance of the revised Policy.

Material updates will also be reflected on our website under the same effective date. Your continued use of the Site after such changes constitutes acceptance of the revised Policy.
